Custody

It is always important that you obtain legal advice if in custody. Once you are under arrest and under investigation for criminal offences, the police have various powers to assist them in their investigation. Such powers must be exercised in accordance with the law.

You also have rights. These rights include the right to remain silent, the right to bail, and the right to have a support person with you.

If arrested, you should contact our experienced criminal law team, who can provide you with advice from your right to remain silent to whether the police can lawfully exercise a power compelling you to undergo a procedure or answer questions.

Bail Applications and Hearings

We offer expert legal representation for bail applications and hearings, ensuring your rights are protected throughout the process. We assist you in preparing and presenting a compelling case for your release, addressing any concerns that the court may have regarding your potential flight risk or danger to the community. We provide thorough guidance regarding the legal criteria for bail, gathering and presenting relevant evidence, and advocating on your behalf to secure a fair and reasonable bail outcome.

List Of Criminal Offences

There are a number of different offences related to illicit drugs. These range from possession to importation of prohibited drugs. No matter what offence you are charged with, it is important to have the assistance of a criminal lawyer who can guide you through the law and ensure you achieve the best result. If found guilty of an offence, this can have a significant impact on your life. At Bell Lawyers, we have experienced criminal lawyers who have represented individuals charged with serious drug offences.

  • Drug Possession: Possession of a prohibited drug is a criminal offence and can attract a maximum penalty of two years’ imprisonment and/or a fine of up to $2,200.
  • Drug Supply: Supply of a prohibited drug includes actual supply, but also encompasses a situation where a person in possession of a prohibited drug over a set weight is deemed to have the drug in their possession for the purposes of supply. Supply itself is defined in the Act and has a very broad definition. There are various penalties for drug supply, depending on the weight. Courts often view this offence seriously and, depending on the weight, may impose a period of imprisonment. Expert legal advice will ensure that an appropriate sentence is imposed.
  • Drug Manufacture: The offence of manufacturing a prohibited drug is serious, with numerous maximum penalties depending on the weight of the drug. Courts have regularly stated that penalties for these offences need to be harsh to deter others from committing this offence.
  • Drug Importation: Importation of border-controlled drugs is a federal offence with very serious penalties. The Criminal Code Regulation 2002, Schedule 2, contains a table detailing the various weights of drugs, identifying whether the offence is a commercial or marketable quantity. The weight can, and does, have an impact on sentencing if found guilty.

Robbery is characterised as a criminal offence in which anything of value is stolen by using force, a threat of force, or causing the victim to be in fear. Depending on the circumstances of the offending conduct, you could be charged with robbery simpliciter or an aggravated form of robbery. Some offences include:

  • Armed Robbery: Any person who, being armed with an offensive weapon or instrument, or being in company with another person, robs or assaults with intent to rob any person, or stops any mail, vehicle, railway train, or person conveying mail with intent to rob, is guilty of a criminal offence.
  • Armed Robbery Resulting in Wounding: Robbery with wounding is an aggravated form of robbery with significant penalties. Wounding is a specific injury to a person and is more than a mere laceration.
  • Robbery or Stealing: The act of taking property belonging to another person with violence or by the threat of violence is defined as robbery and is a criminal offence in NSW.

The law relating to sexual offences, especially regarding consent, is very complicated. If you are charged with any of these offences, it is important to immediately consult with an experienced criminal lawyer. Bell Lawyers has very experienced criminal lawyers who can assist you through any court proceedings.

  • Sexual Assault: Courts impose significant penalties for this offence to deter others from committing it. The majority of the time, the sentence imposed is a term of imprisonment. The maximum penalty is 14 years’ imprisonment.
  • Aggravated Sexual Assault: This offence is similar to sexual assault but is committed in circumstances of aggravation. This can include being in the company of another person or threatening or inflicting actual bodily harm. There are other circumstances of aggravation as well.
  • Unlawful Sexual Touching: Unlawful sexual touching involves touching another person in circumstances where a reasonable person would consider the touching to be sexual, and it occurs without consent.
  • Child Abuse Material: If you possess, use, or distribute child abuse material, you will be found guilty of this offence. A child is defined as any person under 18 years of age. In the vast majority of cases, a court considers imprisonment to be an appropriate sentence.
  • Child Sex Offences / Grooming: Sexual assault charges are perceived as very serious crimes; however, if committed against a child, there are increased penalties depending on the circumstances.
  • Sexual Act Without Consent: The law regarding sexual acts is defined in the Crimes Act. If you commit this offence towards another person without their consent, you could face serious penalties, including up to 2 years’ imprisonment.

Domestic violence offences are criminal offences and can result in convictions. The government has introduced specific sentencing laws in relation to domestic violence offences. These offences can include stalking, intimidation, assault, and destruction or damage to property. The law includes significant penalties, including imprisonment.

Firearm offences are serious in New South Wales and carry very severe penalties. In some instances, a court may sentence an offender to imprisonment. There are numerous offences; generally, the most common are listed below.

  • Unauthorised Possession of Firearms: In NSW, you must hold a firearms licence, or a minors licence if under 18 years, if you wish to possess a firearm. If you do not have a licence, you will commit an offence of unauthorised possession of a firearm.
  • Possess Unregistered Firearms: In NSW, it is a criminal offence for individuals to have firearms in their possession unless the firearm is registered.

Assault includes a range of offences, many of which depend on the seriousness of the injury and the intent an offender has in committing the offence. The more serious the offence, the greater the maximum penalty. All offences include a maximum penalty of imprisonment.

Aside from denying the offence, the defence of self-defence is available. Pursuant to s. 418 of the Crimes Act 1900, if you believe it is necessary to do what you did to defend yourself, another person, or your property AND your actions are a reasonable response to the circumstances as you perceive them, you may be able to defend a charge on the basis of self-defence.

To ensure you have been charged with the correct offence, and to assist you with a plea of not guilty or guilty, it is important to have an experienced criminal lawyer. Bell Lawyers have been representing clients charged with violent offences since we opened in 1984. Offences include:

  • Common Assault: An assault can include a threat of violence or actual violence. Common assault is one of the most frequent charges in NSW courts and has a maximum penalty of 2 years’ imprisonment.
  • Assault Police: If an offender assaults, stalks, harasses, or intimidates a police officer, the offender is guilty of a criminal offence. Courts recognise the role of a police officer and often impose harsh penalties if a person is found guilty of committing this offence.
  • Assault Occasioning Actual Bodily Harm: To be found guilty of this offence, an offender must commit an assault that results in an injury. If found guilty, the maximum penalty is 5 years’ imprisonment.
  • Recklessly Causing Grievous Bodily Harm: A person who causes grievous bodily harm to another person in a reckless manner is guilty of a criminal offence. Grievous bodily harm is recognised as a serious injury, generally more serious than actual bodily harm.
  • Malicious Damage: A person who recklessly or deliberately destroys property belonging to another individual is guilty of a criminal offence. While the property must belong to another, it is important to know you can be found guilty of this offence even if the property is yours, which you jointly own with another.
  • Murder: Murder is one of the most serious criminal offences, with significant penalties reflecting the severity of the crime. Due to the very serious nature of the offence, it is heard in the Supreme Court, usually with a jury.
  • Manslaughter: Manslaughter usually relates to the intent of the offender. If the acts of the offender do not fall within the definition of murder, yet still cause the death of a person, they could be found guilty of manslaughter.

Property offences can include stealing or more serious offences of breaking into premises and stealing property from inside.

  • Larceny: Larceny is an offence where a person takes the property of another with the intention to permanently deprive the other person of that property. For example, if a person shoplifts goods from a store, they would be charged with this offence. The maximum penalty is 5 years’ imprisonment.
Forgery: Forgery is the action of fraudulently and unlawfully copying or imitating documents, signatures, banknotes, art, or other articles for deceptive purposes.
  • Fraud: Fraud is an offence whereby a person deceives another person dishonestly and obtains a financial advantage or causes a disadvantage to another person. It is considered a serious offence with a maximum penalty of 10 years’ imprisonment.
  • Embezzlement: If you have been entrusted with the funds or assets of your employer and misappropriate those funds, you could be guilty of the offence of embezzlement.
  • Break, Enter & Commit Serious Indictable Offence: In simple terms, if a person opens a door or window, or climbs through the roof, and enters a building to commit a serious indictable offence in that building, they are guilty of an offence. The offence also includes circumstances where a person breaks out of a building. A serious indictable offence is any offence that carries a maximum penalty of 5 years’ imprisonment. Examples include larceny, intimidation, or damaging property.
  • Goods in Custody: As per section 527C of the Crimes Act 1900 (NSW), unlawful possession of property, otherwise known as goods in custody, is a criminal offence. There are defences available to this offence.
  • Car Stealing: Stealing a motor vehicle or vessel is a serious offence. Joyriding is a less serious offence referred to as taking and driving a motor vehicle. It is important to know the difference between these offences.
  • Receiving Stolen Goods: If a person knowingly receives or disposes of stolen property, they will be liable to significant penalties.
  • Being Armed with Intent to Commit an Indictable Offence: Section 114 of the Crimes Act 1900 (NSW) refers to the crime of being armed with intent to commit an indictable offence. While there are a number of variations of this offence, one of the most common is possession of housebreaking implements.

Stalking or intimidating another person with the intention of causing that person to fear physical or mental harm is a criminal offence under section 13 of the Crimes (Domestic and Personal Violence) Act 2007 (NSW).

An Apprehended Violence Order (AVO) is an order issued by the Court to protect a person or persons from future harassment, abuse, stalking, intimidation with intent to harm, assaults, and damage to property. It can include orders prohibiting contact or preventing a person from going near nominated premises.

AVOs can include personal or domestic violence orders.

If you breach an order, you can be charged with the criminal offence of contravening an Apprehended Violence Order.

  • Ability to Work with Children: If an AVO has been made against you, this record may affect a ‘Working with Children Check’ and possibly any child-related employment.
  • Security Licence: An AVO can affect you if you wish to apply for a security licence or if you already hold one. Any security licence you hold may be cancelled, or your application for such a licence may be rejected if the Commissioner of Police believes that you are not a ‘fit and proper person’ to hold a security licence.
  • Firearms Licence: If an AVO has been made against you, any firearms licence you hold will be revoked.
