The divorce process in NSW involves several key steps: 

Filing for Divorce

In NSW, you can apply for a divorce if you have been separated from your spouse for at least 12 months and there is no reasonable likelihood of reconciliation. The application can be made individually or jointly with your spouse. It’s important to note that you must be an Australian citizen, resident, or regard Australia as your permanent home to apply for a divorce in NSW. 

Serving Divorce Papers

Once the divorce application is filed, it must be served on the other party. This must be served in person unless the Court has granted leave for service to occur by other means such as post or email.  Proof of service is crucial to ensure that the divorce proceedings can move forward. 

Attending Court Hearings

In most cases, if there are no children under eighteen and the application is uncontested, you may not need to attend a court hearing. However, if there are children involved or the application is contested, a court hearing will be required.

Order for Divorce

to grant an Order for Divorce, the court must be satisfied of the following:

  • The marriage is proved 
  • The parties have been separated for a period of 12 months 
  • Service of the Application for Divorce is proved
  • Where there are children under 18 years, that there are property arrangements for the care welfare and development of the children and
  • If the court is not satisfied that there are property arrangements in place for the care, welfare and development of the children, the Court finds there are exceptional circumstances and grants the Order.
  • Once the Order is made, a sealed copy of the Order is issued one month and one day from the date of hearing at which time it takes effect and formally terminates the marriage.
