Navigating Family Law & Property Transactions in NSW

Separation and Divorce can be overwhelming, especially when property is involved. For many couples in NSW, the family home is often the most significant asset, and understanding how family law and property transactions intersect is crucial to a fair settlement.

The Importance of Legal Advice During Family Law Property Settlements

When dividing property, it’s vital to get expert family law advice to ensure you understand your rights and help protect your interests throughout the process.

An experienced family lawyer will assist in identifying the assets of the relationship that are to be divided and provide you with advice as to your entitlements. Your family lawyer will gather information to be able to conduct an assessment of contributions and future needs. Once you are advised of your entitlements in a property settlement, you are in a position to exchange settlement offers and work towards reaching a negotiated agreement that is fair and just.

Conveyancing in Family Law Property Settlements

Once a property settlement is reached, a qualified property solicitor is essential to handle the transfer of ownership of property. Whether buying out a spouse’s share or selling the property, your property solicitor will ensure that all legal steps are followed, and that the transaction complies with NSW law.

Key Considerations for Dividing Property

  • Consult a Family Lawyer: A lawyer will explain how family law applies to your property division and protects your best interests.
  • Expert Conveyancing: Ensure a smooth transfer with a property solicitor who can manage all necessary legal documentation.
  • Know Your Rights: Understand your rights in the property division to make informed decisions.

Common Questions About Family Law and Property Transactions

Q: How is property divided during separation and divorce in NSW?
A: Property can be divided by agreement between parties usually in the form of Consent Orders or a Binding Financial Agreement.

 Property can also be divided in accordance with Orders made by a Court following a Court hearing.

When determining what Orders are to be made a Court takes the following approach:

  1. Identify whether is it just and equitable to make any property order;
  2. Identify and value the property and financial resources of each of the parties;
  3. Identify and assess the contributions made by each of the parties being financial contributions, non-financial contributions and contributions to the welfare of the family (including contributions as a homemaker and parent)
  4. Identify and assess what is referred to as “the future need factors”. This essentially requires an assessment of the respective needs, resources and earning capacities of each of the parties.

This same approach is taken by your family lawyer when assessing your entitlements in property settlement.

Q: Do I need both a family lawyer and a conveyancer during divorce?
A: Yes. A family lawyer advises on legal rights and entitlements and assist in property settlement negotiations. Whilst every effort is made to try and settle your matter without going to Court, if your property matter does go to Court, a family lawyer will prepare relevant court documents and provide you with legal representation, guide and support you throughout the process.

Our conveyancing team, including our experienced property solicitors, ensure smooth implementation of your property settlement transaction and that relevant exemptions are applied for and obtained such as stamp duty on a family law transfer.
